Dear Sir or Madam: The U.S. Department of Justice Criminal Fraud Section has one comment. On page 23, Section A comment in sought on “defining market manipulation” and ”whether an effect on market prices should be a necessary element of proof…” Certainly, there should be no requirement that one succeed in moving prices…the only requirement should be an attempt to do so….whether successful or not.
