Chapter 1: General Program Authority - Minerals Revenue Management

218 DM 1

1.1 Delegation of Authority. The Director, Minerals Management Service, is authorized to exercise the Secretary=s authority to establish a comprehensive Minerals Revenue Management system and to use that authority to ensure that the Government is paid timely and in full for the leasing of all mineral lands and for its royalty, net profit shares, rentals, bonuses, interest, and other fees for minerals extracted by lessees owed to the United States or Indian lessors; and, of these amounts collected, proper amounts are redistributed on a timely basis to states, Indians, and to other appropriate authorized accounts. The Director, Minerals Management Service, also is authorized to exercise the Secretary=s authority to assess civil penalties as authorized by law, and to settle and compromise disputed amounts of royalty, net profit share, rental, bonuses, interest and other fees and civil penalties. The authorities delegated under this section are granted to the Secretary under the Mineral Leasing Act of 1920, as amended and supplemented (30 U.S.C.181 et seq.); the Mineral Leasing Act for Acquired Lands, as amended (30 U.S.C. 351-359); the Geothermal Steam Act of 1970 (30 U.S.C. 1001-1025); the Indian Allotted Lands Leasing Act (25 U.S.C. 396); the Tribal Lands Leasing Act of 1930 (25 U.S.C. 396a); the Right of Way Leasing Act of 1930 (30 U.S.C. 301-306); the Outer Continental Shelf Lands Act of 1953, as amended (43 U.S.C. 1331 et seq.); 42 U.S.C. 6508; 43 U.S.C. 852; 65 Stat. 248, 252; 16 U.S.C. 520 and section 402 of Reorganization Plan No. 3 of 1946, 5 U.S.C. App. 1; and the Federal Oil and Gas Royalty Management Act of 1982, 30 U.S.C. 1701 et seq; as amended by the Federal Oil and Gas Royalty Simplification and Fairness Act of 1996, Pub. L. No. 104 - 185, 110 Stat.1700, as corrected by Pub. L. 104-200, 110 Stat. 2421.

1.2 Program Activities. The activities performed by the Minerals Management Service under the legislation above and other directives of the Department are stated in its organization statement (118 DM 1-7).

1.3 Limitation. The authority granted in 218 DM 1.1 does not include authority which the Secretary may not redelegate as set forth in 200 DM 1.
