To Whom It May Concern:
I am writing in my capacity as Communications Director for Morning Glory Natural Foods, a 20+ year veteren of the specialty foods, supplements and natural products industry located in Nacogdoches and Lufkin Texas. We support the Dietary Supplement Health and Education Act of 1994.
Former FDA commissioner DR. Jane Henney has testified before Congress that DSHEA provides FDA with the necessary legal auhtority to protect the public health. DSHEA needs the time and support to work as it was intended. The FDA has only recently begun to implement the law by becoming for aggressive in its actions concerning unsubstantiated dietary claims - an unattractive aspect of less reputable companies in the supplement industry. Wildly speculative claims for miracle products make the industry as a whole look bad. We applaud the FDA for recently propsing rules on good manufacturing practices for supplements. Reasonable standards of excellence can only reflect well on all parties involved.
It should be noted that DSHEA actually increases FDA's enforcement powers: The FDA can seize a dietary supplement if it is an unreasonable or significant risk of illness or injury. The Department of Health and Human Servicescan stop the sale of an entire class of dietary supplements if they pose an imminent public health hazard.
DSHEA has increased consumer protection against unsafe products. It has increased consumer access to information about dietary supplements. DSHEA protects and serves: We strongly support DSHEA as it stands and feel that no additional legislative authorityis necessary for FDA to regulate dietary supplements.
