    HEALTH AND SAFETY . . . SAFETY-TOED FOOTWEAR

    Department of Justice, Federal Bureau of Prisons, Federal Correctional Institution, Milan, Michigan and Local 1741, American Federation of Government Employees, AFL-CIO, Case No. 01 FSIP 82, September 24, 2001 (Release No. 443).

    The UNION proposed that "all uniformed staff be issued safety shoes."

    The AGENCY refused to bargain over the issue, claiming the Union had waived its right to negotiate.

    The PANEL declined to take jurisdiction, concluding that the Agency's waiver assertion was not frivolous and that "the Panel is not the appropriate forum for its resolution."
