Marijuana Grower Sentenced To 10 Years

On Monday, December 1, 2008, in the Eastern District Court of California, Jose Magana and his father Jose Miranda were sentenced in federal court for the manufacturing of marijuana on the Six Rivers National Forest. Jose Magana received a 120 months sentence for pleading guilty to manufacturing a controlled substance. Jose Miranda, the father, received a 57 month sentence.

Jose Magana and Jose Miranda were arrested on July 4, 2007, by law enforcement officers from the U.S. Forest Service, Trinity County Sheriff's Department and California Department of Fish and Game. Officers entered the marijuana garden located near Zenia, California and found the two suspects armed with rifles working in the marijuana garden. Magana and Miranda were arrested and charged with the manufacturing of 14,232 marijuana plants, conspiracy to manufacture marijuana and using a communication facility while manufacturing marijuana.

Magana told investigators that they had been living on the National Forest since May 2007, growing their marijuana. The marijuana garden contained a camp and kitchen area that was stocked with large amounts of food and supplies. Also found near the garden were large amounts of garbage discarded upon the Forest. The marijuana garden was located on the Forest approximately ¼ mile off a county road in Trinity County.
