P R O C E E D I N G S

CHAIRMAN KLEIN: Madam Secretary, I understand we that we have some affirmations today. Would you proceed.

ANNETTE VIETTI-COOK: Yes. We have two items for affirmation. The first one's on Consumer's Energy Company Big Rock Point Independent Spent Fuel Storage Installation License Transfer Application; Petition for Reconsideration. The Commission is being asked to act on a Memorandum and Order responding to a Petition for Reconsideration of CLI-07-19, which denied the Request for Hearing and Petition to Intervene filed by Mr. McManemy, the Nuclear Information and Resource Service, and Don't Waste Michigan. The Commission has voted to approve a Memorandum and Order which denies the petitioners' Petition for Reconsideration. Would you please affirm your votes?

CHAIRMAN KLEIN: Aye.

COMMISSIONER MCGAFFIGAN: Aye.

COMMISSIONER JACZKO: Aye.

COMMISSIONER LYONS: Aye.

ANNETTE VIETTI-COOK: Commissioner Merrifield had previously voted to approve this Order and had he been present he would have affirmed his prior vote. On the second item, is on Consumers Energy Company Palisades Nuclear Plant License Transfer Application; Petition for Reconsideration. The Commission is being asked to act on a Memorandum and Order responding to a Petition for Reconsideration of CLI-07-18 which denied the Petition to Intervene filed by the Michigan Environmental Council and the Public Interest Research Group in Michigan. The Commission has voted to approve a Memorandum and Order which denies the petitioners' Petition for Reconsideration and dismisses this adjudicatory proceeding. Would you please affirm your votes?

CHAIRMAN KLEIN: Aye.

COMMISSIONER MCGAFFIGAN: Aye.

COMMISSIONER JACZKO: Aye.

COMMISSIONER LYONS: Aye.

ANNETTE VIETTI-COOK: Commissioner Merrifield again had previously voted to approve this Order and had he been present he would have affirmed his prior vote. I have nothing else.

CHAIRMAN KLEIN: Any comments? Meetings adjourned.
