SUBJECT: STAFF REQUIREMENTS – MEETING WITH ADVISORY COMMITTEE ON NUCLEAR WASTE AND MATERIALS, 9:30 A.M., WEDNESDAY, NOVEMBER 14, 2007, COMMISSIONERS' CONFERENCE ROOM, ONE WHITE FLINT NORTH, ROCKVILLE, MARYLAND (OPEN TO PUBLIC ATTENDANCE)

The Commission was briefed by the Advisory Committee on Nuclear Waste and Materials (ACNW&M) on its accomplishments over the past year, action plan, and future activities and on some specific areas of focus including NRC participation in the International Commission on Radiological Protection (ICRP), low-level radioactive waste, igneous activity at Yucca Mountain, transportation, and in-situ leach uranium recovery activities.

The Committee's Low Activity Radioactive Waste working group and subsequent white paper should address how requirements under the Resource Conservation and Recovery Act (RCRA) Subtitle C compare with 10 CFR Part 61, and whether the RCRA Subtitle C facilities might be bounding for low activity waste.  The white paper should also identify waste facilities that are authorized to dispose of both RCRA Subtitle C and low activity radioactive waste.

At an appropriate point in their review of the in-situ leach uranium recovery process, the staff should consult with the Committee and report to the Commission on whether there are other processes analogous to in-situ leach uranium recovery activities that could help address the groundwater remediation challenges.

At an appropriate time in their review of transportation risks, the staff should consult with the Committee and report to the Commission regarding how the NRC could better inform the public about the risks associated with the transportation of radioactive material compared to other hazardous material transported across the U.S. and the requirements the NRC has put in place to reduce those risks.

At an appropriate point in their review of burn-up credit, the staff should consult with the Committee and report to the Commission on whether there are other sources of fuel burnup data other than the French data, and if there are alternative ways of getting at the same fundamental parameters.

The Committee should continue to monitor the staff's activities associated with the Global Nuclear Energy Partnership (GNEP) and advise the Commission as appropriate with a low priority.
