IN RESPONSE, PLEASE August 31, 2007
The Commission met with representatives of OAS and CRCPD to discuss issues of mutual concern, including coordination with the Department of Homeland Security's Domestic Nuclear Detection Office (DNDO), NRC support of Agreement State training needs, and issuance of orders to implement certain provisions of the Energy Policy Act of 2005, as well as the rulemaking efforts associated with these provisions. The staff should invite DNDO to interact with OAS and CRCPD to enhance cooperation regarding radioactive source security. The Commission acknowledged the importance and value of NRC support for training of State personnel, and will consider policy direction on this matter in its deliberations on SECY-07-0144, "U.S. Nuclear Regulatory Commission Policy on Funding of Certain Agreement State Training and Travel Costs." The Commission recognized the Agreement States' preference for rulemakings, which clearly define compatibility requirements, over the issuance of orders to implement certain provisions of the Energy Policy Act of 2005. The Commission expressed concern that the fingerprinting and background check requirements for unescorted access to certain radioactive materials should be implemented by orders or other legally binding requirements in the near term. The staff should continue to keep the Commission apprised of the progress of, and significant implementation issues associated with, imposing the fingerprinting and background check requirements.
