  1. SECY-06-0240 - Entergy Nuclear Vermont Yankee, LLC, & Entergy Nuclear Operations, Inc. (Vermont Yankee Nuclear Power Station), LBP-06-20 (Sept. 22, 2006): Entergy Nuclear Generation Company & Entergy Nuclear Operations, Inc (Pilgrim Nuclear Power Station), LBP-06-23 (Oct. 16, 2006)

The Commission approved a Memorandum and Order responding to two appeals by Massachusetts Attorney General concerning fire hazards in high-density spent fuel pools. These appeals were filed with respect to the separate decisions of two Atomic Safety and Licensing Boards (LBP-06-20 and LBP-06-23) in two license renewal proceedings. The Memorandum and Order affirms the Licensing Boards' decisions in LBP-06-20 and LBP-06-23.

(Subsequently, on January 22, 2007, the Secretary signed the Memorandum and Order.)

  1. SECY-07-0003 - Exelon Generation Company, LLC (Early Site Permit for Clinton ESP)

The Commission approved an Order requesting comments on the Atomic Safety and Licensing Board's Decision authorizing issuance of the early site permit for the Clinton site. (LBP-06-28)

The Order sets a schedule to provide briefs for the Commission's consideration.

(Subsequently, on January 22, 2007, the Secretary signed the Memorandum and Order.)

1Section 201 of the Energy Reorganization Act, 42 U.S.C. Section 5841, provides that action of the Commission shall be determined by a "majority vote of the members present." Chairman Klein and Commissioners Merrifield, Jaczko and Lyons were present in the Conference Room. Commissioner McGaffigan participated in the meeting via speakerphone.
