CHAIRMAN MESERVE: Welcome. This is an affirmation session. We have two items to come before us this afternoon. Would you please proceed?

MR. BATES: Mr. Chairman and Commissioners, the first item this afternoon is SECY-02-0096, it's a direct final rule on electronic maintenance and submission of information.

The Commission is being asked to act on a final rule that amends the NRC communications regulations to help bring the regulations into compliance with the Government Paperwork Elimination Act. The Commission has voted to approve the publication and implementation of this direct final rule subject to a number of changes that were provided to you earlier in the attachment. Will you affirm your vote please?

CHAIRMAN MESERVE: Aye.

COMMISSIONER DIAZ: Aye.

COMMISSIONER MCGAFFIGAN: Aye.

MR. BATES: The second item is SECY-02-0113, in the matter of Duke Energy Corporation and the McGuire Nuclear Station, as well as the Catawba Nuclear Station, and it deals with the appeal of the Licensing Board Decision 02-04, in the SAMA Contention. The Commission is being asked to act on a Memorandum and Order responding to appeals by the Duke Energy Corporation and the NRC staff of LBP-02-04, which granted the petitions to intervene and requests for hearing of the Blue Ridge Environmental Defense League and the Nuclear Information and Resource Service. The Commission has voted to approve a Memorandum and Order which affirmed LBP-02-04 insofar as it admitted the first part of the Severe Accident Mitigation Alternatives contention related to hydrogen igniters and station blackout, but it reverses the Board's admission of the proposed hydro-electric line as part of the SAMA contention. Will you please affirm your vote?
