SUBJECT: STAFF REQUIREMENTS - AFFIRMATION SESSION, 9:25 A.M., WEDNESDAY, FEBRUARY 6, 2002, COMMISSIONERS' CONFERENCE ROOM, ONE WHITE FLINT NORTH, ROCKVILLE, MARYLAND (OPEN TO PUBLIC ATTENDANCE)

I. SECY-02-0007 - Private Fuel Storage (Independent Spent Fuel Storage Installation) Docket No. 72-22; Review of LBP-01-37

The Commission approved a Memorandum and Order responding to the Atomic Safety and Licensing Board's referral of its decision denying admission of a late-filed contention relating to the threat of a terrorist attack on Private Fuel Storage, L.L.C.'s proposed independent spent fuel storage installation (ISFSI). The Memorandum and Order grants review and sets the case for briefing.

(Subsequently, on February 6, 2002, the Secretary signed the Memorandum and Order.)

II. SECY-02-0016 - Duke Cogema Stone & Webster (Savannah River Mixed Oxide Fuel Fabrication Facility); Applicant's Petition for Interlocutory Review

The Commission approved a Memorandum and Order responding to Duke Cogema Stone & Webster ("DCS") petition for interlocutory review of the Atomic Safety and Licensing Board's denial of DCS's request to reconsider its decision admitting four contentions. The Memorandum and Order grants partial interlocutory review regarding the terrorism issue, establishes a briefing schedule, and declines to rule on the remainder of the petition for review.

(Subsequently, on February 6, 2002, the Secretary signed the Memorandum and Order.)

III. SECY-02-0017 - Dominion Nuclear Connecticut, Inc. (Millstone Nuclear Power Station, Unit No. 3, Facility Operating License NPF-49)

The Commission approved a Memorandum and Order responding to the Atomic Safety and Licensing Board's referral of its denial to admit an intervenor's contention concerning terrorism. The Memorandum and Order accepts the Board's referral and sets a briefing schedule.

(Subsequently, on February 6, 2002, the Secretary signed the Memorandum and Order.)

IV. SECY-02-0018 - Duke Energy Corp. (Mcguire Nuclear Station, Units 1 & 2; Catawba Nuclear Station, Units 1 & 2), LBP-02-04 -- Memorandum and Order Ruling on Standing and Contentions (Jan. 24, 2002)

The Commission approved a Memorandum and Order responding to the Atomic Safety and Licensing Board's certification to the Commission of the intervener's terrorism contentions. The Memorandum and Order accepts the certification and establishes a briefing schedule.

(Subsequently, on February 6, 2002, the Secretary signed the Memorandum and Order.)
