SECY-07-0217 – FINAL RULE - 10 CFR 2.311 "INTERLOCUTORY REVIEW OF RULINGS ON REQUESTS FOR HEARINGS/PETITIONS TO INTERVENE, SELECTION OF HEARING PROCEDURES, AND REQUESTS BY POTENTIAL PARTIES FOR ACCESS TO SENSITIVE UNCLASSIFIED NON-SAFEGUARDS INFORMATION AND SAFEGUARDS INFORMATION" (RIN 3150-A108)

The Commission approved a final rule amending 10 CFR Part 2 to provide for interlocutory review by the Commission of certain rulings on requests by potential parties for access to sensitive unclassified non-safeguards information (SUNSI) and Safeguards Information (SGI).

The Federal Register notice should be reviewed by the Rulemaking, Directives, and Editing Branch in the Office of Administration and forwarded to the Office of the Secretary for signature and publication.

  1. SECY-07-0224 – FINAL RULE:� REGULATORY IMPROVEMENTS TO THE NUCLEAR MATERIALS MANAGEMENT AND SAFEGUARDS SYSTEM (RIN 3150-AH85)

The Commission approved a final rule to lower the threshold of the quantities of special nuclear material (SNM) and certain source materials that require submission of material status reports to the Nuclear Materials Management and Safeguards System (NMMSS).  The final rule modifies the types and timing of submittals of transaction reports to NMMSS.  Licensees will also be required to reconcile any material inventory discrepancies identified in the NMMSS database.

1 Section 201 of the Energy Reorganization Act, 42 U.S.C. Section 5841, provides that action of the Commission shall be determined by a "majority vote of the members present."  Commissioners Jaczko and Lyons were present in the Conference Room.  Chairman Klein participated in the meeting via speakerphone.
