P R O C E E D I N G S [3:30 p.m.] CHAIRMAN JACKSON: Good afternoon ladies and gentlemen. This is an affirmation session. We have two items to come before us this afternoon. Before I ask the Secretary to lead us through the items for affirmation, do any of my fellow Commissioners have any opening comments they would like to make? [No response.] CHAIRMAN JACKSON: If not, Mr. Secretary, please proceed. MR. HOYLE: Thank you, Chairman. The first is SECY-97-201. In this paper the Commission is being asked to approve issuance of a direct final rule to incorporate by reference a national consensus standard in 10 CFR 50.59a(h) which establishes minimum functional and design requirements for the power instrumentation and control portions of safety systems for nuclear power plants. All of you have votedto approve the publication and implementation of this direct final rule. l ask you to affirm your votes. [CHORUS OF "AYES".] MR. HOYLE: Thank you. The second is SECY-97-203. The Commission is being asked in this paper to act on an order responding to appeals which challenge the settlement agreements in the cases of Sequoyah Fuels and General Atomics. In earlier orders, the Commission had granted the Intervenor's petitions for review, and all parties have filed briefs with the Commission regarding both cases. The Commission has voted to approve a modified order and this order accepts that staff's settlements with Sequoyah Fuels Corporation and General Atomics and rejects the Intervenor's arguments for setting aside the settlement agreements.
