Before I ask the Secretary to lead 6 us through the item for affirmation do my fellow 7 commissioners have any comments they would like to make? If 8 not, Mr. Secretary you may proceed. 9 MR. HOYLE: Thank you Madam Chairman, Commissioners. 10 The paper before you is SECY-96-062 containing a proposed 11 order regarding Yankee decommissioning proceeding. In this 12 paper the Commission is being asked to act upon an order 13 affirming two decisions by the Director of Nuclear Reactor 14 Regulation involving decommissioning issues at Yankee 15 Nuclear Power Station. These two decisions are known as DD-16 96-01 and 96- 02. The two decisions were in response to 17 pleadings filed by petitioners challenging the proposed 18 Yankee decommissioning plan. The Commission, with Chairman 19 Jackson and Commissioner Rogers agreeing, have approved the 20 memorandum and order which affirms sua sponte the director's 21 decisions without modification such that both are now 22 considered final agency action. Commissioner Dicus 23 abstained from this matter, but participated in order to 24 establish a quorum of the Commission.
