3         CHAIRMAN JACKSON:  Good afternoon ladies and gentlemen.  4  This is an
affirmation session, we have one item to come 5   before the Commission this
afternoon.  Before I ask the 6     Secretary to lead us through the item for
affirmation, 7 does my fellow Commissioners have any opening comments they 8
     would like to make?  
9         COMMISSIONER ROGERS:  No, thank you.
10        COMMISSIONER DICUS:  No.
11        CHAIRMAN JACKSON:  If not, Mr. Hoyle you may precede.
12        MR. HOYLE:  The item before the Commission is a draft 13    OGC order
in response to Citizens Awareness Network in the 14    Matter of Yankee Atomic
Electric Company.  The Commission is 15 being asked to act on an order
responding to a February 9 16 motion from Citizens Awareness Network and the New
England 17     Coalition on Nuclear Pollution requesting reversal of the 18
     staff's February 2 denial of emergency relief concerning 19 decommissioning
activities at Yankee Rowe.  The emergency 20 relief had been requested by the
petitioner on January 17.  21 Chairman Jackson and Commissioner Rogers have
voted to 22    approve this order that declines to modify the staff's 23   decision since there has
been no showing that would warrant 24   emergency
relief.  Commissioner Dicus has abstained from 25 this matter and is present
today only for the purpose of.1     establishing a quorum of the Commission.  The order being 2     issued
today is also going to direct the staff to address in 3     a director's
decision to be issued next week on February 22 4  the arguments advanced by
petitioners in their February 9 5  motion which are related to their original
motion.  New 6 issues raised in the February 9 motion should be addressed 7
     in a supplemental director's decision.  The Commission also 8    directs
the licensee to provide the NRC staff and the 9   petitioners with at least two
weeks advance notice before it 10  engages in any of the seven new activities
described on page 11     13 of the February 9 motion.  At this time I ask the 12
     Commissioners to affirm their votes.

14        COMMISSIONER ROGERS:  Aye
15        COMMISSIONER DICUS:  Aye
16        MR. HOYLE:  Thank you very much.
17        CHAIRMAN JACKSON:  Is there anything else to come 18   before us this
