3 CHAIRMAN MESERVE: Good morning. Why don't we get
4 underway. We have three items that we need to deal with
5 first in an affirmation session.
6 Madam Secretary, could you proceed?
7 SECRETARY COOK: The Commission is being asked to
8 act on a final rule amending 10 CFR Parts 2 and 50 to
9 clarify its regulations to no longer require antitrust
10 information as part of a post-operating license transfer
11 application, since the Commission is not authorized to
12 conduct antitrust reviews of post-operating license transfer
13 applications.
14 The Commission has voted to approve the
15 publication and implementation of this final rule, subject
16 to the attached changes.

19 SECRETARY COOK: The Commission is being asked to
20 act on an order dismissing proceedings related to the
21 license transfer application at Nine Mile Point. The
22 Commission has voted to approve an order which dismisses
23 these proceedings as moot, based on the Applicant's
24 withdrawal of their license transfer application.

2 SECRETARY COOK: The Commission is being asked to
3 act on a memorandum and order which refers Graystar's
4 request for a hearing on the NRC staff denial of Graystar's
5 application to register the Model GS42 sealed source and
6 Model 1 irradiator to the Chief Judge of the Atomic Safety
7 and Licensing Board panel.
8 The Commission has voted to approve a memorandum
9 and order which refers Graystar's request for a hearing to
10 the Chief Judge of the Atomic Safety and Licensing Board
11 panel and directs the Chief Judge to initiate a Subpart L
12 hearing process.
