3 CHAIRMAN MESERVE: Good morning. Before we get
4 started with today's briefing, I think we have two
5 affirmation matters. Madam Secretary, proceed.
6 MS. VIETTI-COOK: The Commission is being asked to
7 act on a memorandum and order responding to the Petitioner's
8 request to grand them leave to intervene in the Commonwealth
9 Edison Company request for an exemption for both units of
10 design facility from certain requirement in the NRC's
11 regulations involving physical security.
12 The Commission has voted to approve a memorandum
13 and order with attached changes which denies the
14 Petitioner's request for intervention on the grounds that
15 one, the Atomic Energy Act does not mandate that a hearing
16 be offered on an exemption request and two, the Petitioners
17 have not demonstrated their standing to request a hearing.
18 Would you please affirm your votes?

20 MS. VIETTI-COOK: Second item, the Commission is
21 being asked to act on a memorandum and order responding to
22 two appeals filed by Envirocare of Utah, Inc. regarding
23 petitions to intervene and two separate license amendment
24 requests requested by International Uranium Corporation. In
25 both proceedings, the presiding officer dismissed Envirocare

1 for lack of standing. The Commission has voted to approve
2 an order affirming LBP-99-11 and LBP-99-20. Would you
3 please affirm your votes?
