          3              CHAIRMAN JACKSON:  Good morning.  This is an
          4    affirmations session.  You don't have to listen --
          5              [Laughter.]
          6              CHAIRMAN JACKSON:  We have one item to come before
          7    us this morning.  Before I ask the Secretary to lead us
          8    through the item for affirmation, do my colleagues have any
          9    comments they wish to make?
         10              [No response.]
         11              CHAIRMAN JACKSON:  If not, Mr. Hoyle, please
         12    proceed.
         13              SECRETARY HOYLE:  Thank you, Chairman Jackson.
         14              The item is SECY 98-140.  The Commission is being
         15    asked in this paper to act on a memorandum and order which
         16    would affirm the licensing board's decision in LBP 9720, in
         17    which the board denied Envirocare of Utah, Inc.'s request
         18    for a hearing and leave to intervene to challenge a
         19    materials license amendment granted to the Quivera Mining
         20    Company.
         21              Each of you has voted to approve the memorandum
         22    and order which affirms that decision.  May I ask you to
         23    affirm your votes.
         24              CHAIRMAN JACKSON:  Aye.
         25              COMMISSIONER McGAFFIGAN:  Aye.
