The Commission is being asked to act on a Memorandum and Order responding to a petition by the Environmental Law and Policy Center, Blue Ridge Environmental Defense League, Nuclear Energy Information Service, Nuclear Information Resource Service, and Public Citizen for Commission review of Licensing Board decision in LBP-05-19 in which the Board granted summary disposition of the last remaining contested issue – relating to alternative energy sources – and refused to admit for hearing an amended contention. The Commission has voted to approve a Memorandum and Order which denies the petition for review. Would you please affirm your votes? CHAIRMAN DIAZ: Aye. COMMISSIONER MCGAFFIGAN: Aye.
