CHAIRMAN DIAZ: Good morning. Madam Secretary.

MS. VIETTI-COOK: This is in the matter of Yankee Atomic Electric Company.

The Commission is being asked to act on a Memorandum and Order responding to appeals by Yankee Atomic Electric Company and the NRC staff of the Atomic Safety and Licensing Boards’s decision in LBP-04-27 which granted Citizens Awareness Network’s (CAN’s) hearing request and petition to intervene.

The Commission has voted to approve a Memorandum and Order which affirms the Board’s decision in LBP-04-27.
Would you please affirm your votes?

CHAIRMAN DIAZ: Aye

COMMISSIONER MCGAFFIGAN: Aye

COMMISSIONER MERRIFIELD: Aye.

COMMISSIONER LYONS: Aye.

MS. VIETTI-COOK: Commissioner Jaczko had previously voted to approve this memorandum and order and had he been present he would have affirmed his prior vote. That’s all I have.

CHAIRMAN DIAZ: Thank you so much. Does anyone have any comments? If not, we’re adjourned.
