SUBJECT: STAFF REQUIREMENTS - MEETING WITH ADVISORY COMMITTEE ON THE MEDICAL USES OF ISOTOPES, 9:30 A.M., WEDNESDAY, MAY 28, 2003, COMMISSIONERS' CONFERENCE ROOM, ONE WHITE FLINT NORTH, ROCKVILLE, MARYLAND (OPEN TO PUBLIC ATTENDANCE)

The Commission was briefed by the Advisory Committee on the Medical Uses of Isotopes (ACMUI) on several issues of concern to the Committee. The Commission appreciated the opportunity to meet with the ACMUI and recognized the valuable service that the ACMUI provides to the Commission.

The Commission committed to address promptly any regulatory implementation issues associated with uses of radionuclides for Positron Emission Tomography if the Atomic Energy Act is amended to give NRC the authority to regulate accelerator-produced radioactive material.

The Commission supports ACMUI's recommendation to add a Vice-Chairman to the Committee. The NRC staff should revise the Committee by-laws as necessary to effect this change.

As the Commission directed in a Staff Requirements Memorandum on SECY-02-0194, dated February 12, 2003, the staff, with appropriate interactions with the ACMUI, should continue its development of a proposed rule to modify the training and experience requirements in 10 CFR 35 so that the revised rule can be in place as promptly as possible.

The Commission suggests that ACMUI systematically review events and abnormal occurrences in the medical use of nuclear materials for possible trends and apparent root causes and provide feedback through the NRC staff.

Committee members should obtain appropriate clearances for access to safeguards information and should be kept informed of potential new security and source control requirements for those entities, including hospitals, who possess radionuclides of concern in quantities that exceed the NRC's action levels.
