The Commission met in the Commissioners Conference Room, 1F16, in One White Flint North, 11555 Rockville Pike, Rockville, Maryland, at 9:25 a.m., Richard A. Meserve, Chairman, presiding.

		CHAIRMAN MESERVE:  Good morning.  Before we turn to the subject of this morning's meeting,
we have some affirmation matters that we need to deal with.
		Madam Secretary, will you proceed?
		MS. VIETTI-COOK:  The Commission is being asked to act on an order responding to a motion by
Fansteel Oklahoma and the NRC staff to dismiss the appeal of the presiding officer's decision to grant
Oklahoma a hearing on Fansteel's application for a license amendment relating to the decommissioning of its
Muskeego -- Muskeego --
		CHAIRMAN MESERVE:  Muskogee.
		MS. VIETTI-COOK:  -- Muskogee --
		(Laughter.)
		-- Oklahoma site.  The Commission has voted to approve an order dismissing the appeal. 
Would you please affirm your votes?
		ALL:  Aye.
		MS. VIETTI-COOK:  The second item, the Commission is being asked to act on a memorandum and
order responding to petitions for review of LBP 9940 filed by Intervenors Grace, Sam, and Marilyn Morris,
and by Eastern Navajo Dyne, against Uranium Mining.  The memorandum and order also responds to a petition
for review of LBP 9930.
		The Commission has voted to approve a memorandum and order which, one, grants review and
reverses LBP 9940; two, orders that the proceeding be resumed in approximately six months; and, three,
grants review and affirms the last half of LBP 9930, which addressed NEPA and environmental justice issues.
		Would you please affirm your vote?
		ALL:  Aye.

		CHAIRMAN MESERVE:  Good.  Thank you.
