  1. SECY-04-0095 - Request to Export up to 140 Kilograms of Weapons-Grade Plutonium Oxide (PuO2) to Cogema's Cadarache and Melox Facilities in France (XSNM03327)

The Commission1 approved a Memorandum and Order responding to petitions to intervene in export license XSNM03327 filed by Greenpeace International, Charleston Peace, and Blue Ridge Environmental Defense League. The Memorandum and Order denies the petition to intervene and directs the Office of International Programs to issue the export license.

(Subsequently, on June 15, 2004, the Acting Secretary signed the Memorandum and Order.)

1. Section 201 of the Energy Reorganization Act, 42 U.S.C. Section 5841, provides that action of the Commission shall be determined by a "majority vote of the members present." Chairman Diaz and Commissioner Merrifield were present in the Conference Room. Commissioner McGaffigan participated in the meeting via speakerphone.
