IN RESPONSE, PLEASE May 11, 2004
The Commission approved a final rule, subject to the attached changes, amending 10 CFR 50.48 to allow performance-based approaches to meet fire protection requirements. Following incorporation of these changes, the Federal Register notice should be reviewed by the Rules Review and Directives Branch in the Office of Administration and forwarded to the Office of the Secretary for signature and publication.
The Commission also has approved publication of the notice of interim enforcement discretion related to this rulemaking in the Federal Register. The staff is encouraged to continue their focus and ensure that the associated implementation and inspection guidance for this rule is finalized in a timely manner so this effort is brought to closure. Attachment: Changes to the Final Rule in SECY-04-0050
On page 18 of the Federal Register notice, the sentence beginning on line 6 should be revised to read: "NFPA 805, Chapter 1, states the radioactive release performance criteria to maintain radiation release from the effects of fire suppression activities as low as reasonably achievable and not to exceed 10 CFR Part 20 limits." |
