I. SECY-04-0040 - Private Fuel Storage, LLC (Independent Spent Fuel Storage Installation) Intervenor Ohngo Gaudadeh Devia's Motion to Reopen the Case Record on Contention "O" -- Environmental Justice

The Commission approved a Memorandum and Order responding to Ohngo Gaudadeh Devia's (OGD) motion to reopen the case record on contention "O" -- environmental justice. The Memorandum and Order denies OGD's motion to reopen the record on Contention "O."

(Subsequently, on March 24, 2004, the Secretary signed the Memorandum and Order.)

II. SECY-04-0041 - Private Fuel Storage (Independent Spent Fuel Storage Installation) Docket No. 72-22-ISFSI
The Commission approved a Memorandum and Order responding to appeals by Private Fuel Storage, L.L.C. (PFS) and the State of Utah for review of a series of Atomic Safety and Licensing Board decisions (unpublished due to concerns over disclosing proprietary information) on financial assurance. The Memorandum and Order grants review of PFS's claims of error and denies review of Utah's claims of error.

(Subsequently, on March 24, 2004, the Secretary signed the Memorandum and Order.)
