IN RESPONSE, PLEASE
I. COMSECY-04-0004 - Notice and Order for Louisiana Energy Services The Commission1 approved a Notice and Order responding to Commission direction in a March 5, 2003, Staff Requirements Memorandum (SRM) on SECY-02-0219 related to an application filed by Louisiana Energy Services to possess and use source, byproduct, and special nuclear material and to enrich natural uranium to a maximum of 5 percent U-235 by the gas centrifuge process. The Notice and Order provides for notice of receipt of application for license, notice of availability of applicant's environmental report, notice of consideration of issuance of license, and notice of hearing and Commission order. Further, the Notice and Order provide guidance and directives on the treatment of issues in the proceeding on the application and a milestone schedule for conduct of the proceeding. (Subsequently, on January 30, 2004, the Secretary signed the Notice and Order.)
1. Section 201 of the Energy Reorganization Act, 42 U.S.C. Section 5841, provides that action of the Commission shall be determined by a "majority vote of the members present." Chairman Diaz and Commissioners McGaffigan were present in the Conference Room. Commissioner Merrifield participated in the meeting via speakerphone. |
