RE: Open Comment Period – Administrative Subpoena and Notice of Lien

Section 452(a)(11) of the Social Security Act requires the Secretary of Health and Human Services to promulgate administrative subpoena and notice of lien forms for use in interstate cases. The Federal Office of Child Support Enforcement (OCSE) developed the forms which were effective October 28, 1997. The last revised forms were published in 2005 and AT-05-04, dated February 4, 2005, provided information as to how the child support enforcement community could provide comments. No comments were received and the revised forms were effective January 31, 2005. The forms expire in January 2008 and are at http://www.acf.hhs.gov/programs/cse/forms/.

In compliance with the requirements of Section 3506(c)(2)(A) of the Paperwork Reduction Act of 1995, the Administration for Children and Families is soliciting public comment on the forms. As of July 24, 2007 a notice for public comment has been posted to the Federal Register. The notice appears on page 40306-40307 in Volume 72, Number 141.

The need to reauthorize the forms provides the opportunity to consider revisions. Please send your comments and suggestions to Yvette Hilderson Riddick at yvette.riddick@acf.hhs.gov. When commenting, please be sure to reference OMB control number 0970-0152 for the Administrative Subpoena and OMB control number 0970-0153 for the Notice of Lien. Consideration will be give to comments received by September 24, 2007.
