Reemployment Rights

The Uniformed Services Employment and Reemployment Rights Act (USERRA) provides reemployment protection and other benefits to members of the National Guard and Reserve called up from their civilian jobs to serve on active duty.  The law prohibits employer discrimination because of military obligations.  Current beneficiaries of USERRA are our servicemembers participating in the occupation of Operation Iraqi Freedom/Operation Enduring Freedom.

USERRA is administered by the Department of Labor.  The National Committee for Employer Support of the Guard and Reserve (NCESGR) serves as an ombudsman between employers and their employees who are Guard and Reserve members.

In Public Law 108-454, the Veterans Benefits Improvement Act of 2004, Congress increased employer-sponsored health coverage from 18 months to 24 months, and required employers to provide notice to employees of the rights, benefits and obligations of employers and employees that apply under USERRA.
