& LICENSING BOARD TO HOLD HEARING APRIL 23 |

An independent Atomic Safety
& Licensing Board appointed by the U.S. Nuclear Regulatory Commission will
conduct an evidentiary hearing in Chattanooga beginning April 23 on a Tennessee
Valley Authority appeal of a $110,000 civil penalty sought to be imposed by
the NRC for alleged violation of NRC employee protection requirements.
The hearing will commence at 9:30 a.m.(EDT), at the United States Bankruptcy Court, Courtroom A, Historic U.S. Courthouse, 31 East 11th Street, and will continue April 24-26, beginning at 9:00 a.m, and, to the extent necessary, on April 30 - May 9, also commencing at 9:00 a.m. The members of the Atomic Safety & Licensing Board established to preside over the hearing are Charles Bechhoefer, Chairman; Ann Marshall Young and Dr. Richard F. Cole. Parties to this proceeding are TVA and the NRC staff. Issues to be considered are whether TVA violated NRC requirements by discriminating against a former employee for engaging in protected activities; and, if so, whether an NRC Order imposing a civil monetary penalty for the violations should be sustained. Documents related to this proceeding issued prior to December 1, 1999, are available for public inspection in the NRC Public Document Room (PDR) at One White Flint North, 11555 Rockville Pike, Rockville, Maryland 20852-2738, telephone 301- 415-4737 or 1-800-397-4209.
