NRC STAFF PROPOSES $3,000 CIVIL PENALTY AGAINST WEST VIRGINIA
COMPANY FOR VIOLATIONS OF NRC RADIATION SAFETY REQUIREMENTS
Printable Version PDF Icon

The Nuclear Regulatory Commission staff has proposed a $3,000 civil penalty against American Geotech, Inc. of Charleston, West Virginia, for violations of NRC safety requirements related to the use of licensed material.

In a letter to the company, Luis A. Reyes, Administrator of the NRC’s Region II office in Atlanta, said an NRC inspection and investigation found that the company had intentionally failed to provide approved dosimetry (devices used to measure radiation exposure) to an employee who was exposed to radiation, and that the company had failed to properly train an individual prior to allowing his unsupervised use of a moisture density gauge containing radioactive material.

Reyes said no actual radiological consequences occurred as a result of the violations, but that the civil penalty was being proposed because of the deliberate nature of the violations and the fact that the NRC identified the violations. The NRC staff has concluded that the company’s corrective actions taken and planned to prevent recurrence are adequate.

The NRC’s letter, its enclosures and the company’s response will be made available through the agency’s Web site at www.nrc.gov/reading-rm/adams.html. Help in accessing the document is available from the NRC Public Document Room at 301-415-4737 or 1-800-397-4209.

The company has 30 days from receipt of the letter to either pay the civil penalty or to protest its imposition.
