Performance-Based Actions

Fountain PenMost Federal agencies are authorized under Chapter 43 of Title 5 to demote, or remove employees for "unacceptable performance."  Such actions are commonly referred to as performance-based actions.  We issue governmentwide regulations at 5 CFR Part 432 which implement the law.  Actions based on unacceptable performance may also be taken under Chapter 75 of Title 5 and are regulated at 5 CFR Part 752.  We review decisions of the Merit Systems Protection Board and arbitrators to ensure that the laws and regulations are properly applied, and provide guidance to Federal agencies and employees on how to address and resolve poor performance.
