"Today's filing by the U.S. Chamber of Commerce offers
nothing new in the way of arguments opposing OSHA's Cooperative
Compliance Program (CCP). Contrary to the Chamber's claim,
nothing new in the Constitution prohibits OSHA from implementing
this innovative enforcement program. The Fourth Amendment does
not outlaw common sense and it does not outlaw the CCP."
"Employers included in this program reported the highest rates
of serious injuries and illness in a nationwide survey. CCP
enables OSHA to work with these employers and help them reduce
hazards in their workplaces."
"What's more, CCP is not a regulation. It is an enforcement
program that allows OSHA to target its resources where they
are needed most. Targeting hazardous work sites and offering
to work with employers is a smart and efficient way for OSHA
to leverage its limited resources. Hundreds of work sites
in pilot programs have bottom-line experience that proves
this concept works to reduce hazards, protect workers and
lower workers compensation costs."
