The following summaries provide information on the date that HOME waivers were granted and denied, the State or Local Field Office making the request, the situation which gave rise to the need for a program waiver, and the regulatory citation. 1/7/99	IL	Granted request to waive the requirement that Peoria, IL repay HOME funds expended for a project that was never completed because the property owner died prior to construction completion (92.205(e)). Denied request to waive that same regulation for a different project which failed to be completed because the owner refused the contractor access to the property – suggested mediation in this case.	92.205(e)
1/7/99	OH	Grants a partial waiver to permit the consortium to have until 6/1/99 (the end of the current consortium period) to align its program years. Denies the request for an additional extension. (Cuyahoga County Consortium)	91.402(a)
1/12/99	MA	Granted request to permit the City of Newton, MA to determine 95% of median area purchase price on the median of housing sales within the City, rather than on sales within the entire Brookline Newton Waltham Water City Consortium due to the extreme range of median values among the four consortium members and considerable gap between FHA maximum mortgage limits. 1/12/99	MN	Granted request to waive the regulatory prohibition against committing HOME funds to an original HOME-funded project later than one year after the completion of the project. Sufficient funds were not requested in the original application due to lack of time for completion, and City of Nevis was unaware that it was eligible to reapply for funds a year after project was completed. 1/12/99	MO	Granted request to waive expenditure deadline requirements under 92.500(d)(1)(C) for four projects being rehabilitated with HOME disaster funds. These projects had experienced delays, some of which resulted from issues beyond the City’s control, such as fire and environmental contamination. Without an extension of the expenditure deadline, the City risked losing the unexpended HOME disaster funds. (City of St. Louis)	92.500(d)(1)(c)
4/5/99	WI	Granted a request to permit the State to consider a single-family HOME assisted property in the City of Sheboygen as completed, even though the work could not be finished as the home was destroyed by a storm. (State of Wisconsin)	92.251 92.502(d)
4/6/99	TN	Granted a request to permit Memphis CHDO to provide transitional housing to youth. The State is not under legal obligation to house youth in need of this service; as such, they are not wards of the State, and are eligible for HOME assistance. 4/21/99	KS	Permits the substitution of a comparable affordable housing unit for a unit that was inadvertently sold to an over-income tenant by the non-profit El Centro. HUD considers the substitution to constitute compliance with the affordability requirements, therefore a waiver is not required. 4/30/99	IL	Grants a limited extension of the expenditure deadline for FY 1993 HOME Disaster Funds. Funds will be used to assist homeowners whose homes have been ravaged by recent floods to purchase comparable units located outside of the flood plain. (Lake County)	92.500(d)(1)(c)
5/4/99	MO	Partial waiver granted for expenditure deadline requirements for HOME Disaster Funds. An earlier waiver had granted the full request by the City to extend the expenditure deadline until December 31, 1999. However, citing statutory requirements under Section 1405 of the National Defense Authorization Act for FY 1991, the Department stated that it was only able to extend the deadline until September 21, 1999. 5/6/99	MD	Permission granted to waive adherence to the definition of “single room occupancy (SRO)” at 24 CFR 92.2 which requires either sanitary facilities or food preparation facilities to be in each unit of an SRO project which was a conversion of nonresidential space. The City of Baltimore indicated that it would have been infeasible for the project to go forward if a separate sanitary or food preparation facility was required in each unit. Abandoning the activity would not address the needs and desires of the community to provide suitable low-income housing for the elderly. (City of Baltimore)	92.2
6/7/99	CA	Waiver granted to extend the commitment and expenditure deadline for FY 93 HOME Disaster Funds. Legal issues had stalled a rehabilitation project for which the remainder of funds had originally been reserved. (Los Angeles)	92.500(d)(1)(b) and (c)
6/9/99	OK	Waiver granted for HOME property standard requirements under 92.251. Due to the extensive damage caused by tornadoes in Oklahoma, many counties were declared disaster areas. The City proposed to use HOME funds for emergency repairs to homes and on-site infrastructure damaged by the tornadoes. (Midwest City)	92.251
6/9/99	AR	Waiver of affordability requirements under 92.254 (a)(4) for two HOME-assisted units that were destroyed by tornadoes. (Little Rock)	92.254(a)(4)
6/9/99	OK	Waiver of HOME property standard requirements in order to facilitate the provision of emergency housing assistance and on-site infrastructure for housing damaged by tornadoes. (State of Oklahoma)	92.251
6/29/99	FL	Waiver granted to extend the disbursement deadline for FY 93 HOME Disaster Funds. The State requested that funds which had been reserved for technical assistance and uncommitted program funds be transferred to its homebuyer assistance account. These funds would then be used in conjunction with the Florida Housing Finance Corporation’s Mortgage Revenue Bond Program. (State of Florida)	92.500(d)(1)(c)
7/30/99	KS	Denied request to waive the 90-60 rule at 92.216(a). Language in the HOME Statute (NAHA) prohibits HUD from suspending this requirement. (Sedgwick County)	92.216(a)
7/30/99	MA	Denied Boston request for waiver of section 572.220(a)(1) of the HOPE 3 regulations which requires that HOPE 3 recipients assure that matching contributions equal to not less than 33 percent (or 25 percent for grants awarded after April 11,1994). The HOPE 3 Program match requirement is established by statute and may not be waived.	572.220(a)
8/27/99	OK	Waived HOME property standards (§ 92.251) to permit units damaged by tornadoes to receive HOME funds for emergency repairs. Waived $1,000 minimum HOME investment (§ 92.205(c)) for these units to permit HOME funds to pay for repairs not covered because of high insurance deductibles. 9/3/99	OH	Denied the fourth request from the Montgomery County/Kettering Consortium for a permanent waiver to permit the consortium to operate on two different program years.
