Box below contains the Terms and Conditions AWWA Career Center User Agreement The purpose of the American Water Works Association (AWWA) Internet-based Career Center (“Water Jobs”) is to offer job seekers and employers (together termed “User”) an online site to post information relevant to their employment needs. Use of the Water Jobs site and participation in the associated job-posting service constitutes agreement to the following terms and conditions. These terms and conditions are subject to change at any time. Any use of the site following the posting of any new or modified User Agreement constitutes your acceptance of the modified agreement, whether or not you have reviewed it. It is the User’s responsibility to periodically review the current version of this User Agreement posted on the Water Jobs site, and to ensure ongoing compliance with such currents. If you do not agree with any of the terms and conditions stated within, you may not use this Web site or any associated services. The following terms and conditions are in addition to all other then effective legal notices, policies, and terms of use posted on AWWA’s website. TERMS AND CONDITIONS FOR USE OF AWWA CAREER CENTER User Terms User agrees to submit to the Water Jobs site only information that is proper, accurate, complete, and related to the purpose of the site. User agrees not to use the Water Jobs site in a manner that could infringe the intellectual property rights of others or that could violate the privacy, publicity, contractual, or other rights of others. User agrees not to submit to the Water Jobs site information or other material, or hyperlinks to information or other material, that is unethical, illegal, fraudulent, defamatory, obscene, threatening, abusive, or harassing. AWWA may decide in its sole discretion whether information or material violates the foregoing requirements. User agrees not to submit to the Water Jobs site information that markets or promotes products or services unrelated to the specific employment information being posted. User agrees not to submit information to the Water Jobs site that does not belong to or with respect to which User does not have the authority to post such information. User agrees not to use the Water Jobs site for anything other than its intended purpose. User agrees not to post nonexisting or false job openings, or engage in any other activity that collects resumes or other information under false pretenses or for a purpose other than filling an employment need. User agrees not to upload any item to the Water Job site that damages, circumvents, jeopardizes, or cracks computer/network systems, extracts protected data, or otherwise interferes with the Water Job site (e.g., viruses, Trojan horses, worms, time bombs, etc.). User may access only those services that have been authorized for User’s use. User agrees not to make its password or other relevant account information available to others, and further agrees not to use the password or account information of another User. User shall promptly notify AWWA in the event the security of its account information or password may have been jeopardized, or a new password may be necessary. User may not access, collect, record, alter, or interfere with account information that does not belong to User. User may not assign, sell, sublicense, lease, or otherwise transfer User’s right to access the Water Jobs site or its services. User may not copy, duplicate, reverse engineer, or otherwise use any of the coding, markup language, or software that comprises the Water Jobs site or any components thereof. User accepts sole responsibility for the accuracy of information he submits to the Water Jobs site. User accepts sole responsibility for any communication with potential employees/employers, or any employment that may be offered or accepted as a result of the User’s participation on the Water Jobs site. AWWA Terms AWWA reserves the right to alter, edit, or remove from Water Jobs any content that it determines to be inappropriate to the site or its purpose, including any information it deems to be unethical, illegal, fraudulent, defamatory, obscene, threatening, abusive, harassing, or irrelevant. This includes the right to remove any hyperlinks to materials deemed to be inappropriate by AWWA. AWWA reserves the right to remove any information that it determines could result in strain to or damage of AWWA or Users’ computer/network services. User account information shall be protected by AWWA in accordance with the general terms of its Copyright and Privacy Policies and Terms of Use as stated on the www.awwa.org Web site. Copyrights and Trademarks All designs, text (other than employer or candidate information), layout, and software contained on the Water Jobs site are the sole and exclusive property of AWWA and are protected by the applicable copyright, trademark, service mark, trade dress, and other intellectual property laws. AWWA hereby grants User a limited, nonexclusive, nontransferable license to access and use Water Jobs and the software and materials contained therein for the purpose stated above. Users may not remove, download, copy, recreate, disassemble, modify, destroy, translate, reverse engineer, or decompile any software or other material on the Water Jobs site for any purpose. Users may download and maintain single copies of employer or candidate information from the Water Jobs site for personal use only. Users shall not, nor permit others to, copy, adapt, display, transmit, store, sell, or use any material from the Water Jobs site in any manner other than as set forth herein without prior written consent from AWWA. Trademarks and trade dress belonging to AWWA or others appear on or are accessible through the Water Jobs site. Access to the site does not constitute authorization to reproduce these trademarks or trade dress for any purpose without prior written consent from the owner. Disclaimers and Limitations of Warranties AWWA makes no guarantees as to the level of success a User may achieve by using the Water Jobs site. User will not be entitled to any refund, rebate, or retribution for use of the Water Jobs site and its associated services that User determines to be unsuccessful. AWWA makes no guarantees that material submitted to Water Jobs will be accessible for the entire term of its listing. Computer outages, software failures, and other technical and non-technical issues may periodically cause the site to be inaccessible. AWWA further disclaims any responsibility or warranty for the performance of the Internet or the security of any transmission over the Internet. AWWA makes no guarantees as to the accuracy, completeness, or truthfulness of any information posted on the Water Jobs site, including the identity of Users. Any damage incurred by reliance on this information is not the responsibility of AWWA. By using the Water Jobs site, the User assumes all responsibility for and risk arising from use of and reliance upon the information provided on the site. User assumes all liabilities and risk associated with interaction with individuals or companies the User comes in contact with through the use of the Water Jobs site. User acknowledges that AWWA shall function solely as a conduit for the receipt, storage, processing, and transmission of employment listings, candidate information, and other related information. User agrees to release AWWA from liability resulting from any damages or occurrences resulting from the use of the Water Jobs site. References and links to products and services belonging to third parties are provided for User convenience on the Water Jobs site and do not represent AWWA’s affiliation with or endorsement of such products or services or their providers. In accordance with the Terms of Use as stated on the www.awwa.org Web site, materials accessible from or added to this site by third parties, including, though not limited to, job listings or comments posted in discussion groups, are strictly the responsibility of the third party who added such materials or made them accessible. While AWWA reserves the right to monitor third-party postings or discussions and to remove materials that it believes are inappropriate, AWWA does not endorse such third-party material, and is neither obligated to nor undertakes to control, monitor, edit, or assume responsibility for any such third-party material. User agrees that this Use Agreement shall be governed under the laws of Colorado, without giving effect to its conflict of laws principles. All disputes involving AWWA arising from or in any manner related to this User Agreement or the Water Jobs site shall be settled exclusively in courts or other alternative dispute resolution tribunal located in Denver, Colorado. Termination of Site and Site Access AWWA reserves the right to change the contents of the Water Jobs site or to discontinue it at any time. AWWA reserves the right in its sole discretion to deny any person or company access to or use of the Water Jobs site or any portion thereof.
