Although the civil penalty would have been fully mitigated based on the normal civil penalty assessment process, a base civil penalty was assessed in accordance with Section VII.A.1.g of the Enforcement Policy to reflect the significance of maintaining control of licensed material.

12/11/2008 On December 11, 2008, a Notice of Violation was issued for a Severity Level III violation.  The violation involved the failure to use a minimum of two independent physical controls that form tangible barriers to secure a portable gauge whenever the gauge was not under the control and constant surveillance of the licensee as required in 10 CFR 30.34(i).  Specifically, the licensee stored the gauge in a storage room with the key in the door lock rendering the physical barrier ineffective. Additionally, a second independent physical barrier was not provided.

09/22/2005 On September 23, 2005, a Notice of Violation and Proposed Imposition of Civil Penalties in the cumulative amount of $19, 200, was issued for three Severity Level II problems, one Severity Level II violation, and two Severity Level IV violations, associated with brachytherapy treatments that resulted in unintended radiation doses to five patients. Because these violations directly contributed to significant health consequences for Patients Nos. 3, 4, and 5, each of those three events is categorized as a separate Severity Level II problem in accordance with the NRC Enforcement Policy. In addition, the licensee became aware that three medical events had occurred and did not notify the NRC of the events until more than one day after the medical events were discovered, contrary to 10 CFR 35.3045(c) that requires licensees to notify the NRC Operations Center, by telephone, no later than the next calendar day after discovery of such events. The events associated with Patients Nos. 1 and 2 are categorized as separate examples of a Severity Level IV problem in accordance with the NRC Enforcement Policy due to the more limited health consequences associated with these medical events.

04/27/2005 On April 27, 2005, an immediately effective Confirmatory Order was issued to confirm commitments made as part of a settlement agreement concerning an Order Imposing Civil Monetary Penalty in the amount of $9,000 issued on February 1, 2005. The action was based on a Severity Level II violation for discrimination against an employee for engaging in certain protected activities (reporting safety concerns to his employer or to the NRC). In response to the Order, the licensee requested the use of the NRC’s alternative dispute resolution (ADR) process to resolve differences it had with the NRC concerning the violation. As part of the settlement agreement that was reached through the ADR process, the licensee agreed to pay a civil penalty in the amount of $1,200 and to take additional corrective actions to emphasize the importance of a Safety Conscious Work Environment at their facility.

07/14/2008 On July 14, 2008, a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $9600 was issued to Source Production and Equipment Co., Inc. (SPEC) for a deliberate Severity Level II problem of 10 CFR 71.3.  Two violations were identified involving the transport of NRC licensed material without a license because SPEC did not comply with NRC Certificate of Compliance (CoC) No. 5979 requirements.  Specifically, on July 15, 2003, December 4, 2003, and May 20, 2004, SPEC shipped licensed material to Mexico and 1) the end caps of the package were physically and dimensionally different from those approved in the CoC, and 2) the package was not inspected prior to the shipments as required by the CoC.  There are no known actual health and safety consequences associated with the shipments.  The Notice also included a Severity Level IV violation of 10 CFR 71.105(d) involving the failure to provide required training to individuals performing pre-shipping inspections of the Model No. 5979 transportation package.  This Severity Level IV violation was not subject to a Civil Penalty.

Based on the facts that Star-Lite Global stopped importing and distributing the Kr-85 bulbs by the fall of 2003, no longer operates or conducts transactions, plans to file for bankruptcy, and the low safety significance of the Kr-85 bulbs that it distributed, the NRC is exercising discretion to refrain from issuing a civil penalty in this case.
