2.0 Site Status Summary

Foote Mineral Company (FMC), formerly the Vanadium Corporation of America, held an Atomic Energy Commission (AEC) and NRC source material license.

FMC occupied an industrial site south of Cambridge, Ohio from the 1950's to 1987, at which the 120-acre site was purchased by Shieldalloy Metallurgical Corporation (SMC). With the purchase, SMC assumed license responsibility (NRC License No. SMB-01507) for the low-level radioactive slag remaining on the site from the previous owners operations. After purchasing the site, SMC decontaminated the manufacturing facilities, most of the grounds, and consolidated the radioactive material into two piles, the East Slag Pile (ESP) and the West Slag Pile (WSP). In the fall of 1993, the NRC identified that slag from the former FMC site may have been used as fill at offsite locations. Subsequent inspections indicated that FMC slag with elevated levels of radionuclides had been used as fill in commercial and residential applications. A number of properties were remediated as a result of a class action suit against Cypress Foote Mineral Company (CFM) formerly FMC. SCM and CFM developed an agreement, which allowed the placement of the off-site slag on the WSP. On August 31, 1999, the Ohio Department of Health, Bureau of Radiation Protection (BRP) became a USNRC Agreement State and assumed regulatory authority over possession and use of radioactive materials in Ohio. On January 30, 2001, SMC's NRC license no. SMB-01507 was amended / converted into BRP license no. 11900300000. On March 6, 2002, the "Decommissioning Plan" (DP) "for the Cambridge, Ohio Facility - Shieldalloy Metallurgical Corporation" was approved. Metallurg has completed capping both the East and West Slag Piles. A site-wide MARSSIM Final Status Survey has been completed and the report is being finalized for submission for regulatory review and concurrence. A long-term Operation and Maintenance (O&M) Plan has undergone an initial review by ODH (radiological) and OEPA (chemical). A groundwater monitoring plan for inclusion into the long-term O&M plan is under development. Site wide unrestricted release (dose based) - Soil Criteria: Th-232 & progeny <11pCi/g; U-238 & progeny <7.1 pCi/g. [ NUREG 1757 Screening Values [65 FR 114, page 37186; 06.13.02]). 3.0 Major Technical or Regulatory Issues

Metallurg was unable to demonstrate to ODH's satisfaction that the uncapped slag piles met the 25 mrem/yr unrestricted release criteria and ODH rules do not allow for license termination under a restricted release. Thus, upon ODH concurrence that site decommissioning requirements have been completed, the Metallurg site decommissioning license will be amended / converted into a long-term source material possession license.
