On November 2, 1979 the United States Nuclear Regulatory Commission (USNRC) granted Advanced Medical Systems, Inc. a license to manufacture USNRC approved sealed sources at its 1020 London Rd., Cleveland, Ohio location. On December 13, 1989 AMS' license was renewed with an expiration date of December 31, 1994. In October of 1994, the Executive Director of the Northeast Ohio Regional Sewer District (NEORSD) served an Order upon AMS indicating that the NEORSD would no longer provide wastewater treatment services for the AMS London Rd. facility. In November 1994, AMS submitted a timely renewal license application to the USNRC. Also in November of 1994, NEORSD installed plugs in the AMS connections to the sewage treatment system rendering the facility drain systems non-functional. Since then, AMS has ceased source production and has concentrated its efforts on those that could facilitate the timely reconnection of the facility to the NEORSD system. On August 31, 1999, the Ohio Department of Health, Bureau of Radiation Protection (BRP) became a USNRC Agreement State and assumed regulatory authority over AMS' radioactive materials license. On March 19, 2003, The Supreme Court of Ohio denied an appeal by AMS of a decision by the Cuyahoga County Common Pleas court thus affirming the Ohio Department of Health's order denying AMS' application to renew its Ohio Radioactive Materials License. On June 1, 2004, AMS submitted its 1020 London Rd. site Decommissioning Plan (DP) and supporting documentation to the BRP. AMS made ten supplemental submittals in response to BRP staff questions about the DP and associated work plans. The BRP approved the DP on May 23, 2005. Site wide unrestricted release (dose based) "Building/structure surfaces: Total 7050 dpm/100cm2 ²³; removable 705 dpm/100cm2 ²³ [NUREG/CR-5512, Vol.3 screening criteria]. Soils: Co-60 <3.79 pCi/g [NUREG/CR-5512, Vol.3 screening criteria]. Groundwater: Co-60 <100 pCi/l [USEPA Drinking Water Limit equal to 4 mrem/yr].

3.0 Major Technical or Regulatory Issues

The BRP approved a phased approach to the site decommissioning to allow remedial activities to commence while plans for the next phase are being review and approved. On June 6, 2005, Phase 1 of the site decommissioning commenced. On May 2, 2006, Phase 1 was verified as being complete. On June 2, 2006, Phase 2 of the site decommissioning commenced. Phase 2 includes remediation of the Waste Hold Up Tank (WHUT) Room and the Hot Cell. When Phase 2 is complete, the entire interior of the building will have been released for unrestricted use. Phase 3 involves the exterior of the buildings, soils and groundwater. ODH rules do not allow for license termination under a restricted release.
