I work for the Government and know I'm in (or was in) the wrong retirement plan. What do I do now?

If you believe you are eligible under FERCCA, you should contact your agency's Human Resources Office. OPM works with representatives from your agency to provide guidance in determining an employee's eligibility for relief under FERCCA. You will be asked some preliminary information to assess your potential eligibility, however, a final determination can not be made until your Official Personnel Folder (OPF) is reviewed. You will be notified of your eligibility in writing.

If you are about to retire, let your agency know. We at OPM will work with your agency to get you the information you need before you retire.

I'm in the wrong retirement plan. My agency hasn't corrected my records. Is there anything that my agency should be doing now to correct the error?

Your agency shouldn't do anything if your error lasted for at least 3 years of Federal service. We have asked agencies to stop processing those retirement coverage corrections until we can work out the details necessary to implement FERCCA. Please be assured that any delay in correcting your records will not adversely affect you.

I am a current employee and recently received a copy of my Letter of Ineligibility. I noticed that OPM sent this letter to my agency who sent a copy to me with a decision letter stating there is no retirement coverage error in my case. Why was the letter sent to my agency and not directly to me?

Under OPM regulations your agency makes retirement coverage decisions. OPM sends the letter to your agency so that your agency can review the information. Once your agency reviews the letter and confirms our findings, they send a final decision letter to you. The decision from your agency that your retirement coverage is correct, in other words that you are ineligible for relief under FERCCA, may be appealed to the Merit Systems Protection Board (MSPB), if you choose to do so.

I am a current employee. Once I sign and return the Election Form enclosed in the Election Option Package, who is responsible for implementing my election and correcting my records?

Your current employing agency will correct the records in accordance with OPM instructions. If an employing agency no longer exists as an organization, and there is no successor agency, then OPM will correct the records.
