NRC LICENSING BOARD TO CONTINUE HEARING SEPTEMBER 9
IN MARYLAND ON TVA APPEAL OF NRC STAFF DISCRIMINATION RULING

A hearing before an independent Atomic Safety & Licensing Board, appointed by the U.S. Nuclear Regulatory Commission to hear a Tennessee Valley Authority appeal of a proposed $110,000 civil penalty for alleged violation of NRC employee protection requirements, will resume on September 9 in Rockville, Md.

The hearing will resume at 11:00 a.m. EDT in the ASLBP Hearing Room, 3rd Floor, at 11545 Rockville Pike. It will continue, to the extent necessary, on September 10 - 13, beginning at 9:00 a.m. EDT each day, at the same location. As the hearing proceeds, the Board may make changes to this schedule, as appropriate. The first portion of the hearing was held during April, May and June in Chattanooga, Tenn.

Parties to the proceeding are TVA and the NRC staff. The Board is considering whether TVA violated NRC requirements by discriminating against a former employee for engaging in protected activities; and, if so, whether an NRC Order imposing a civil monetary penalty should be sustained.

Members of the Atomic Safety & Licensing Board presiding over the hearing are administrative judges Charles Bechhoefer, Chairman, Ann Marshall Young and Dr. Richard F. Cole.

The hearing is open to observation by interested members of the public.
