Employment Discrimination Complaint Process

Consistent with its policy on Equal Employment Opportunity (EEO), the U.S. Nuclear Regulatory Commission (NRC) has established a discrimination complaint process, which is available to employees and applicants for employment with the agency, who believe that they have been subjected to discrimination based on any of the following factors:

  • race, color, or national origin
  • religion (including reasonable accommodation for religious practice)
  • gender (including gender-based wage discrimination or harassment)
  • age (40 and over)
  • mental or physical disability (including reasonable accommodation)
  • sexual orientation

The NRC’s discrimination complaint process is also available to employees and applicants, who believe that they have been subjected to reprisal or workplace harassment for participating in an activity that is protected by the related EEO Statutes and Regulations, or for opposing practices that are made unlawful by those statutes. Note that discrimination based on sexual orientation is not covered by the the regulations of the U.S. Equal Employment Opportunity Commission (EEOC) exit icon, as defined in Title 29, Part 1614, of the Code of Federal Regulations (29 CFR Part 1614 exit icon). Allegations of discrimination on that basis may be pursued with the NRC's Office of Small Business and Civil Rights (SBCR).

In addition, the EEOC regulations require Federal agencies to establish or make available an Alternative Dispute Resolution (ADR) Program, as a means of resolving EEO complaints related to employment discrimination. As such, ADR supplements (rather than replacing) the NRC's discrimination complaint process. In this context, employees or applicants may request ADR at the pre-complaint stage and/or the formal complaint stage of the discrimination complaint process (i.e., after filing a formal complaint, but prior to requesting an EEOC hearing). When ADR is requested, the NRC primarily uses mediation (provided by contractors).

The NRC’s discrimination complaint process (including the ADR Program) is administered by SBCR, in accordance with the EEOC regulations defined in 29 CFR Part 1614. For additional information, see the following related pages:
