Hearing Opportunities and License Applications

This page provides notices of major licensing applications submitted to the U.S. Nuclear Regulatory Commission (NRC), as well as notices of applicants' intentions to file applications that would constitute major licensing actions. This page also provides current information regarding major licensing and enforcement proceedings undertaken by the NRC. The availability of this information provides ample opportunities for members of the public to easily identify any such proceedings for which they may wish to request a hearing or file a petition to intervene. The NRC has developed resources for understanding NRC's Rules of Practice for Hearings, 10 CFR Part 2. Requests for hearings submitted in response to hearing opportunity notices published in the Federal Register or on this page on or after October 15, 2007, must be filed in accordance with the E-Filing rule, 72 Fed. Reg. 49,139 (Aug. 28, 2007), now incorporated into 10 CFR Part 2.  Further information about E-Filing is available on the Electronic Submittal page.

Letters of Intent to Apply for a Major License Application

Some of the applications referenced in these letters of intent are likely to contain or reference Safeguards Information (SGI). Because of the time required to perform a required background check, the NRC has established procedures to allow members of the public who may wish to request a hearing to request access to SGI if there is "a need to know." Before submitting a request, please contact the individual listed for that application, to determine if the application is likely to contain SGI.

Deadline for Filing Hearing Requests and Intervention Petitions

The deadline for filing a request for a hearing or a petition to intervene, where there is no Federal Register notice of an opportunity for hearing, is determined by the date of the related notice on the NRC's Web site. See 10 CFR 2.309(b)(4)(i). Where an opportunity for hearing is not published in the Federal Register, the information on this page constitutes the Web site notice referenced in 10 CFR 2.309(b)(4)(i), and all determinations of the timeliness of hearing requests and intervention petitions for purposes of Section 2.309(b)(4)(i) will be based upon the date of notice publication on this page. Where an opportunity for hearing is published in the Federal Register, the deadline for hearing opportunity is determined by the date of publication in the Federal Register and not the date of publication on this page.

The NRC will update this page to add notices as the NRC receives new applications or notices of intent for major licensing actions, and as opportunities arise for the public to request a hearing or file a petition to intervene in major licensing and enforcement proceedings. The NRC will also update this page to remove notices following the deadline for timely filing of a hearing request or intervention petition.

Extensions of Time to File Hearing Requests and Intervention Petitions

Given the early notice that this page provides with respect to licensing applications (and the intent to file applications), together with the information provided on other pages of the NRC's Web site and the broad public disclosure provisions in 10 CFR 2.390, the Commission anticipates that it will very rarely grant extensions of time to file hearing requests or intervention petitions.
