Overview

This website is intended to provide external entities listed below with information on how to use data from the Centers for Medicare & Medicaid Services (CMS):

The website outlines the policies and procedures to follow when submitting a formal data request for CMS data. The Criteria page delineates basic instructions when submitting a data request to CMS. Please read this page carefully, changes have been made to the submission criteria. There are different types of data requests categories and each has different requirements/instructions and documentation that must be followed and submitted.  For further information, please select the type of request category that best identifies your request.

CMS's policy on use of Medicare and Medicaid data is to maximize the amount of data that are available while assuring adherence to privacy confidentiality requirements that protect the interests of our Medicare and Medicaid beneficiaries and individual physicians.

This website includes policies on use of data and data files from CMS Privacy Act Systems of Records published in the "Federal Register." Information and usage on data files most commonly requested are

            1. Disproportionate Share Hospital (DSH) Rate Data

            2. EDB Customized State File

            3. Identifiable Data

            4. Limited Data Sets (LDS)

            5. Long Term Care Minimum Data Set (LTCMDS)

            6. Outcome and Assessment Information Set (OASIS)  

The Research Data Assistance Center (ResDAC) is a CMS contractor that provides free assistance to researchers interested in using Medicare and/or Medicaid data for their research. All requests for identifiable data must be reviewed by ResDAC prior to submission to CMS. Effective Immediately, please note that any organization requesting CMS that has an EXPIRED CMS Data Use Agreement will not receive authorization to obtain any new data until their expired Data Use Agreement has been resolved. The retention date stipulated the timeframe in which the information can be used. If your Data Use Agreement is about to expire, and your project is still in need of the CMS data, then you will need to request to CMS an extension date on the Data Use Agreement. However, if you have completed the need for the data, you must contact CMS an request that the Data Use Agreement be closed by either providing written certification that you have destroyed the CMS data or physically return the data to CMS.  For further information please go to DUA Extensions, Closeouts, Returning or Destroying CMS Data.
