Consent Decree Filed in Tissue Residue Case against Jay Parker and Sons Livestock Grower/Dealer and Dairy Farm

On June 13, 2006, a Consent Decree of Permanent Injunction was filed in the U.S. District Court for the Northern District of Indiana, against Jay Parker and Sons, LLC and Chris J. Parker and Ted R. Parker as individuals responsible for the operations of the family owned livestock grower/dealer and dairy farm.  The milk from this farm is sold for human consumption and the farm sells dairy animals to other farms or for slaughter for human consumption.  The injunction action is based on twenty-three (23) illegal residues in the edible tissue of ten bovine animals (nine cows and one veal calf) sampled by the U.S. Department of Agriculture’s Food Safety Inspection Service (USDA/FSIS) between June 23, 1999 and April 19, 2005.  The drug residues found by USDA/FSIS included antibiotics such as streptomycin, neomycin, gentamicin, oxytetracyline, flunixin, and sulfadimethoxine that were found to be above the FDA-permitted tolerance levels or in some cases where no established tolerance for the new animal drug has been established.  FDA’s Center for Veterinary Medicine is particularly concerned about the extra-label use of sulfadimethoxine which is specifically prohibited from extra-label use in lactating dairy cows as specified by Title 21, 530.41 of the Code of Federal Regulations (http://www.fda.gov/cvm/Documents/530_41.txt .)

Under the terms of the Consent Decree, the defendants must implement systems for identifying animals, record-keeping, drug control, drug accountability, and drug residue withdrawal control.

FDA's Detroit District Office conducted the investigations that lead to this Consent Decree.  FDA's Center for Veterinary Medicine Division of Compliance and FDA’s Office of the Chief Counsel, the United States Department of Justice's Office of Consumer Litigation, and the U.S. Attorney's Office in the Northern District of Indiana were responsible for processing and filing the case.
