Automated Export System (AES) Enforcement effective February 1, 2009
U.S. Customs and Border Protection (CBP) announced that penalties will be imposed beginning February 1st, 2009 for failure to comply with the U.S. Bureau of Census, Mandatory Automated Export System regulations.
- CPB may penalize the U.S. Principal Parties in Interest, Foreign Principal Parties in Interest, freight forwarders, authorized agents, brokers, carriers and other parties to the export transaction.
- Exporters can review the AES regulations at
http://www.census.gov/foreign-trade/regulations/index.html
- Exporters may be required to report shipment details electronically in AES prior to cargo loading on board a vessel for export from the U.S.
- Exporters must provide “K” Line with the proof of filing (ITN), exception or exemption legend for all bookings by the established cut-off.
- “K” Line’s SCAC for AES = KKLU
“K” Line may be penalized for loading non-compliant cargo, therefore, cargo that is missing the proof of filing citation, exemption or exception legend by the established cut-off will be rolled. Cargo that is on dock and rolls will be subject to a $200.00 fee plus all associated charges at the port as per applicable tariff.
