ACHP Seeks Public Comment on Kitt Peak, Arizona, Telescope Issue

The Advisory Council on Historic Preservation (ACHP) is requesting public comments by February 15, 2007, regarding a grant to fund construction of the Very Energetic Radiation Imaging Telescope Array System (VERITAS) at Horseshoe Canyon, Kitt Peak, Arizona.

The National Science Foundation (NSF), the lead federal agency for the proposed construction grant, recently notified the ACHP of its determination that NSF and the participants in the Section 106 consultation process have failed to agree on the terms of a Memorandum of Agreement for this undertaking. Regulations provide that in such situations the ACHP may choose either to join consultation or notify the agency and proceed to comment in accordance with 36 CFR 800.7(c), Failure to resolve adverse effects, Comments by the Council. The ACHP has notified NSF that it will comment on the undertaking. The ACHP will provide its comments to NSF by February 27, 2007. The ACHP is soliciting public views for its consideration and requests that any such views be provided as early as possible and no later than February 15, 2007.
