NOTICE OF AMENDMENT

Sixth Circuit Rules 10, 27, 28, 30, and 101
Sixth Circuit Internal Operating Procedures 10 and 11
Sixth Circuit Guide to Electronic Filing

EFFECTIVE JANUARY 12, 2009

The Sixth Circuit Court of Appeals has adopted amendments to several of its local Rules, Internal Operating Procedures, and the Guide to Electronic Filing. These amendments are all effective as of January 12, 2009. The text of the Rules, the Procedures, and the Guide, reflecting these amendments, are available at the links provided above.

The amendments to the Rules were adopted without prior public notice or opportunity to comment upon the Court’s determination that an immediate need existed therefor; 6 Cir. R. 47(a). Pursuant to that Rule the court will welcome comment from any interested persons not later than April 13, 2009. Comments may be addressed to ca06-rules_comments@ca6.uscourts.gov.

Notice: Re: Electronic Case Filing (ECF)

Effective June 1, 2008 the U.S. Court of Appeals for the Sixth Circuit has implemented the ECF system for the electronic filing of court documents. A special registration form which must be completed for that purpose can be accessed at this link. Registration Information

The court has developed a training database for counsel's use in familiarizing themselves with the how-to's of filing in ECF. Counsel are encouraged to access that database and practice with ECF at this link. ECF Training Database

Increase in Compensation for CJA Counsel
The case compensation limits applicable to counsel appointed under the Criminal Justice Act have been increased from $5,000 to $5,600 for representation in direct criminal appeals, appeals from the denial of habeas corpus or § 2255 relief. The increases apply in cases in which any work was performed on or after October 13, 2008.

The maximum hourly compensation rate for non-capital representation has increased from $94 to $100 for work performed on or after January 1, 2008. The maximum hourly compensation rate for capital federal post-conviction proceedings has increased from $166 to $170 for work performed on or after January 1, 2008.
