  ORDER

OCCUPANCY AND USE RESTRICTIONS
BLACK HILLS NATIONAL FOREST
BLACK ELK WILDERNESS

Pursuant to 36 CFR 261.50 (a) and (b), the following acts are prohibited in the Black Elk Wilderness.


1.                  Entering or  being in the Black Elk Wilderness as part of a group larger than 25 people and/or livestock combined.  {36 CFR 261.57(a)}

2.                  Camping within 1/4 mile of Harney Peak summit or within the Harney Peak Lookout building.  {36 CFR 261.58(e)}

3.                  Camping within 100 feet of water sources.  {36 CFR 261.58(e)}

4.                  Disposing of human waste within 100 feet of a stream or water.  {36 CFR 261.57(g)}

5.                  Shortcutting a switchback in a trail.  {36 CFR 261.55(e)}

6.                  Hitching, tethering, or tying a horse or other saddle or pack animal to a live tree except while loading or unloading.  {36 CFR 261.58(aa)}

7.                  Hitching, tethering, or hobbling a horse or other saddle or pack animal within 100 feet of a stream.  {36 CFR 261.58(aa)}

8.                  Possessing a dog not on a leash or under strict voice control.  {36 CFR 261.58(s)}

9.                  Possessing a bicycle, stroller, wagon, cart or other motorized or mechanical vehicle.  {36 CFR 261.57(h)}

Pursuant to 36 CFR 261.50(e), the following are EXEMPT from this order:

1.                  Persons with a permit specifically authorizing the otherwise prohibited act or omission.

2.                  Any Federal, State, or local officer, or member of an organized rescue or firefighting force when involved in the performance of an official duty .
