Alaska's NPDES Authorization

EPA Region 10 has responsibility for administering the NPDES program for the State of Alaska, including issuing and enforcing wastewater discharge permits. On May 1, 2008, the State submitted a final NPDES program application. State NPDES programs are authorized by §402(b) of the Clean Water Act, 33 U.S.C. §1342(b). Alaska's application has been reviewed by EPA for completeness and is being reviewed for approvability under §402(b),(c) and (n) of the Clean Water Act, 33 U.S.C. §1342(b),(c) and (n); 40 CFR Part 123; and other applicable statutes and regulations. Once EPA approves the proposed program, authority to administer the NPDES program will be delegated to the State.
