CMS has authority to waive or modify requirements that hinder the design of, the offering of, or the enrollment in, Part D arrangements sponsored by employers or unions for their retirees. This waiver authority allows employer and union plan sponsors to directly contract with CMS to offer Medicare Prescription Drug Plans (PDPs) and Medicare Advantage plans that include prescription drugs (MA-PDs). Employer or unions may also contract with existing PDPs and MA-PDs to provide enhanced Medicare prescription drug coverage to their retirees. This chapter is a compilation of employer/union health sponsor guidance and waiver policy. It will be updated annually.
