Clean Water Act Dredge and Fill Permits Compliance ProgramLANL is responsible for making sure that it is in compliance with Clean Water Act (CWA) Sections 401 and 404. Section 401 requires state certification when applying for a federal permit to either build or operate a facility that has a potential to discharge pollutants into any body of water. Section 404 sets guidelines for a program to regulate dredge and fill into any of the United States bodies of water. The Dredge and Fill Permits Compliance Program's plan describes the process used by ENV-RCRA for implementation of the CWA Sections 404 and 401, Dredge and Fill Permit Program. The CWA Section 404, administered by the Corps of Engineers (COE), and Section 401, administered by the New Mexico Environment Department (NMED), ensure that the surface water quality is protected from unregulated discharges of dredged or fill material. LANL will comply with the current regulations relating to the CWA Sections 404 and 401. Water quality personnel gather, organize, and coordinate the permit information for submittal to the COE and NMED. They also track permit status and submit the permit closeout letter to the COE. ![]() |
